Welcome to Prime Equipment’s Online Bidding & Selling Platform designed to bring buyers & sellers together online. Internet users can both sell their own items and bid on items posted by others. Please read the Terms and Conditions below before registering!

 

Terms and Conditions

 

1.  Bidder Number:  All online bidders/sellers must submit an application for bidding approval and receive a permanent bidder number from Prime Equipment before actual bidding can begin. If approved, Prime Equipment will return by email the bidder number within 24 hours of receipt of the application. (For SPAM software users, please have “prime-equipment.net” set as an approved email sender in your email system in order to receive this and other emails from us.) This bidder number and your driver's license number will allow you to bid on posted items and to access your User Page where you will find your current bids, past invoices, links for item alerts, how to update your data file and how to become a seller on the Prime Equipment web site. Bidders wishing to use resale certificates or exempt status MUST email the proper form to sales@prime-equipment.net BEFORE taxes will not be charged to you. The link for these forms can be found on the registration or file update page.

 

2.  Sell Conditions:  All items are sold “as is, where is” with no warranty or guarantee implied or intended by the seller or the auctioneer. All sales are final and the bidder is responsible for knowing which item he is bidding on. We recommend each bidder make every effort to confirm item descriptions to their satisfaction by visual inspection or at least by making contact with the seller for confirmation before bidding on any item. Once the item is declared sold, it becomes the responsibility of the buyer with all liabilities attached thereto. Loading assistance is NOT usually available unless otherwise stated. Should the item turn up missing at pickup time, please contact the local police authorities and report them as stolen as no refunds will be made by the Auctioneer or the seller.

 

3.  Bidding:  All bids will require a maximum bid amount. Our program will automatically increase your bid incrementally up to your maximum amount whenever another bid is placed on the item above your current high. You may increase your maximum bid at any time and the amount of your current bid will not be increased! Each bid will be increased by an established increment set by Prime Equipment on each item.

a) All bidding for the online auction items ends at 2 PM on the closing day listed for the item.

b) All bidding is for a quantity of ONE. Items with quantities greater than one will be sold by each with the high bidder choosing the number he wants times the high bid amount . When bidding, be sure and enter the quantity you desire.

c) ALL REAL ESTATE BIDS ARE SUBJECT TO SELLER APPROVAL!

 

4.  Payment:  Acceptable payment is by Visa, MasterCard, Discover, or American Express credit cards only. Online auctions will be invoiced within 4 hours of the closing time with payment being applied to the credit card on file unless prior arrangements are made. All winning bids will be notified by email with an invoice showing contact information, lots purchased, taxes collected, and the total amount charged to the credit card on record within 24 hours of the completion of the sale. A 10% BUYERS PREMIUM which is taxable will be added to each purchase, unless otherwise noted. All purchases are due and payable in US funds at Quitman, Wood County, Texas, USA.
 

5.  Pickup of Items:  All items must be removed by noon on the fifth business day after the sale, unless other arrangements are made with the seller during this time frame. Items not picked up will be considered abandoned and properly disposed of by the seller with no refunds!  Included in all emailed invoices will be a contact for scheduling pickup within the 5 business days allotted. Buyers MUST present an invoice as proof of purchase when picking up their purchases from the seller! A copy of all online auction invoices is available from the bidder's user page after processing and will remain there.

 

6.  Titles:  Vehicle title papers will be issued by the seller within 10 working days of the sale to the buyer as registered unless otherwise notified within 24 hours of notice of award. Odometer readings are not guaranteed unless so indicated.

 

7.  Accuracy:  The items described in this online auction listing are assumed to be true and correct to the best ability of the owner and the auctioneer. Any users found intentionally falsifying descriptions will be banned from this site!

 

8.  Non-Paying Bidders:  Anyone who fails to complete any transaction associated with any bids placed with Prime Equipment’s Online Auctions, will be banned from using this site and barred from attending any Prime Equipment onsite auctions! Bidders failing to complete transactions in excess of $1000.00 will be sued for breach of contract! Any legal action arising from transactions related to any online auction conducted by Floyds Prime Equipment, Inc. (dba Prime Equipment & Auction Company) will be conducted in Wood County, Texas, USA and under the current laws of the State of Texas, USA. All operations of this web page are based in Texas and operated under the current laws of Texas, regardless of user or operator computer location.

 

9.  Licensing:  Prime Equipment auctioneers are licensed by the Texas Department of License and Regulation, PO Box 12157, Austin, Texas 78711, 512-463-5522. Any complaints or compliments can be turned into the Department for resolution if not properly resolved by Prime Equipment personnel.
